Commission consults on possible countermeasures and readies WTO litigation in response to US tariffs

The European Commission has launched a public consultation on a list of US imports which could become subject to EU countermeasures, if ongoing EU-US negotiations do not result in a mutually beneficial outcome and the removal of the US tariffs.

The list put to consultation concerns imports from the US worth €95 billion, covering a broad range of industrial and agricultural products. The Commission is also consulting on possible restrictions on certain EU exports of steel scrap and chemical products to the US worth €4.4 billion. This consultation is designed to address both the US universal tariffs and the tariffs on cars and car parts.

The consultation concerns the following 2 lists of products:

  • Goods subject to counter-tariffs  Circabc
    In addition to the already adopted list of counter-tariffs in response to the US tariffs on steel and aluminum, DG TRADE prepared another list covering approx. €95bn worth of goods, with automotive, chemicals, medical devices, machinery, and many other sectors, including agrifood. 
    The rate of the tariffs is not indicated in the public consultation and is still being decided.
  • Goods subject to export restrictions Circabc

    On top of the counter-tariffs, a short list of targeted goods has been prepared to which export restriction measures would apply: these include steel and aluminum scrap, specific chemicals (that have a US dependency), and  flavouring for beverages.
    The public consultation does not specify what kind of export restriction measures these products would be subject to.

Stakeholders are encouraged to submit their views, and the consultation will remain open until 10 June, 12:00 (UTC+01:00), Brussels time.
